I know that no one really cares if Lindsay Lohan smokes or not. When you look at the big picture smoking is not really the biggest thing this train wreck needs to worry about.

Still, the fact that she has quit and is consistently working out with a trainer every morning goes to prove that she is at least trying to get her shit together.

Or maybe she’s preparing herself for possible upcoming jail time for violating her probation. I’ve recently learned from watching Lockup Raw that inmates are not allowed to smoke. So that whole using cigarettes as money thing doesn’t happen anymore. Guess what they use now? Ground coffee.

It’s hilarious watching these hardened drug-dealing killers trading little plastic baggies of Folgers around for food/sex/clothing on this show.

Even if the DA drops the felony grand theft case completely Lindsay Lohan may find herself in jail for a year. How you ask? By the sheer beauty of our legal system. TMZ breaks it down:

Prosecutor Danette Meyers could go back to court and ask the judge to violate Lindsay’s DUI probation … on grounds she stole the necklace.
The judge in the probation case could then hold a hearing — without a jury — to determine if Lindsay did indeed pilfer the jewelry.
Now here’s the big problem for Lindsay.  In a criminal case, the D.A. must prove guilt beyond a reasonable doubt — in other words, convincing a jury that there’s a 98 to 99% chance that she did the deed.

But in a probation violation case, all the judge has to decide is that it’s more likely than not that she stole the jewelry — in other words, that there’s a 50.1% chance she did it. Sources connected with the D.A.’s office tell us … prosecutors believe they could ask for more than 1 year in jail if the judge decides Lindsay violated her probation.
And one final piece of bad news. It’s very possible if the D.A. dismissed the grand theft case, the probation violation matter would go back to Judge Elden Fox in Beverly Hills, who has totally lost patience with Lindsay.

Although we can’t know for sure how this is going to play out, I just don’t believe any judge is going to go easy Lindsay Lohan this Friday when she returns to court for failing her drug tests.

“Lindsay could be remanded directly into custody on Friday, pending the probation violation hearing, and it’s very likely that Judge Fox will do that,” a source told Radar. “Lindsay was allowed to remain out on bail last time until her probation violation hearing, but Judge Fox probably won’t give her that privilege because of her failed drug test, and this is her second probation violation hearing in less than three months.”

Lohan could get 30 days for each failed test, which would make a 60-day sentence.

It’s unlikely that she will serve an entire 60 days..but maybe they can manage to hold this dangerous criminal for more than 2 weeks this time.

Apparently Lindsay Lohan is a huge pain in the ass to represent. This makes two lawyers to quit on her in as many weeks.

TMZ reported this morning that the man she thought was going to save her from doing any jail time, Robert Shapiro, has decided he will not represent her when she turns herself in.

In Lindsay’s defense, you can’t blame her. Dude helped O.J. get off a murder wrap but he can’t keep Lilo from serving 15 days or so?
