As TMZ first reported, the LAPD is conducting a criminal battery and child endangerment investigation after Gabriel allegedly pushed the nanny with Nahla in her arms. And before the alleged pushing, the nanny says Gabriel screamed at her and hurled a racial epithet. In addition, we’ve learned the L.A. County Dept. of Children and Family Services is also conducting a child endangerment investigation.

Kamdem also claims Gabriel often yelled at Nahla, causing the child to cower and cry. And she told police… when Nahla had a rash he refused to treat it. Kamdem quit last week after Gabriel allegedly shoved her. Gabriel’s rep tells TMZ, “Anyone can file a police report at any time, regardless of it being accurate.

“Once they broke up he became verbally threatening to Halle,” Aubry’s former friend and business partner Stephane Bibeau tells PEOPLE in this week’s cover story. “He is a vindictive guy.” Bibeau and other sources close to Berry, 44, claim that Aubry, 35, has used a racial slur against her.

It’s a classic he said/she said thing. In the beginning it seemed they were both willing to share custody without any drama, but since then money has gotten in the way and words have been said that have changed the course of this little girls life forever. Someone needs to tell them both to get it together and get over themselves. I’m not sure what Halle’s problem is but most sources say that Gabe big issue is monetary. Halle Berry don’t need to sit around and cry over her baby daddy Gabriel Aubrey. According to People she has moved on with sexy new co-star. Who also happens to be her same age…since the cougar thing didn’t work out with Gabe this could be a smart move on her part.

Halle has been spotted cozying up to her Dark Tide costar Olivier Martinez, 44, in his hometown of Paris. The two have been seen smooching and exploring the city, embracing a Hollywood-style romance straight out of a movie.

“It was the classic ‘I’m going to kiss you here in a dark corner’ move,” an onlooker tells PEOPLE of Berry and Martinez’s romantic romp. “And she was waiting to be kissed.”

The duo spent Sunday afternoon combing through the streets arm in arm, taking in a pit stop at the Paris flea market.

“They had their arms around each other as they walked,” an onlooker tells PEOPLE. “They were both smiling and laughing Their body language was very flirtatious. They definitely seemed like a couple – absolutely looked like more than friends.”

The two sped off on Martinez’s motorcycle before dining at the intimate Casa Bini restaurant. After dinner, Martinez led Berry on a cozy back-streets tour of the St. Germain district at dusk, including Place Saint-Sulpice and its fountain. En route to his Paris pad, the couple stopped along a narrow street and kissed in a doorway for two minutes, says an onlooker.

Wow. Every time I see this guy I feel bad for Halle. He is a dreamboat. Although…at this point she is probably so annoyed with whatever he did wrong he is looking about a sexy at Zach Galifianakis to her.

“Gabriel just felt it wasn’t working anymore,” the source said. “When they were first together the 9-year age difference between them didn’t faze him, she was the most beautiful woman he had ever dated and he was totally in love. But as time went on he started feeling it more and more. Also, Gabriel started noticing other women, and being attracted to other, and he felt it just wasn’t right to stay with Halle in those circumstances.”

The source told Radar that Gabriel just wanted a 50/50 custody agreement, which Halle agreed to, and did not go after her money.

“As much as it can be it’s been an amicable split,” the source said. “They both traveled a lot for work anyway, so they were used to spending time apart for long periods, but I think Halle has taken it pretty badly, she truly loved Gabriel and thought she had found the one.”

And lest we forget, this body just gave birth six months ago. I’d say this is a hellava way to say, ‘I’m back biatches!’

That’s a pretty strenuous fitness plan for someone who just gave birth two months ago. Halle’s diet doesn’t sound as scary as her workout routine. She is “eating lots of vegetables, lean proteins and complex carbohydrates, as well as drinking a large quantity of water.”

“Halle had come to the hospital at 4am in the morning because the felt like she was going into labor. It was a bit scary because her blood pressure was skyrocketing and everyone was a little tense. She’s a diabetic so that was complicating matters as well. The doctors checked the fetal heart rate and everything seemed okay. After a while Halle’s blood pressure came down. She wasn’t dilating anymore so at around 2:45pm they let her go home. 

“Halle felt her contractions come on a lot more intensely later that night so she came back to the hospital at 11:00pm Saturday night. 

“Halle was overcome with emotion when she finally held her little girl. She said everything she had gone through was worth that moment. The tears kept coming as Halle didn’t even want the nurses to take her baby to clean her up and measure. It was a truly beautiful scene.”

During an October 19 taping of The Tonight Show With Jay Leno Halle was showing Jay some distorted pictures of herself when she pissed off the some over sensitive Jewish folk. When Halle was introducing a photo of herself with a huge nose she blurted out:

‘Here’s where I look like my Jewish cousin!’”

Sadly, now sweet Halle is having to eat crow to get back in the good graces of our Jewish friends.

“I so didn’t mean to offend anybody – and after the show I realized it could be seen as offensive, so I asked Jay to take it out, and he did. What happened was I was backstage before the show and I have three girls who are Jewish who work for me. We were going through pictures to see which ones looked silly, and one of my Jewish friends said [of the picture], ‘That could be your Jewish cousin!’ And I guess it was fresh in my mind, and it just came out of my mouth. But I didn’t mean to offend anybody.”
